Social Media Rules of Engagement

We envisage creating a supportive, inspiring community and have created this Social Media Rules of Engagement policy to make clear our expectations of acceptable behaviour on our channels and consequences of unacceptable behaviour.

 

When we use the words ‘we’, ‘us’ or ‘our’ we mean Benview Farms Pty Ltd ABN 59 613 378 206. This policy applies to www.farmtoforkonline.com, our blogs or related forums (if any) and our social media platforms. If you view, post, comment on, or otherwise use any blogs or websites controlled by us or any of our social media channels including a closed Facebook group (collectively called ‘channels’), you must comply with this policy.

When we use the words ‘you’, ‘yours’ or ‘user’, we mean you, the user of our channels.

 

We may update this policy from time to time and the new provisions will apply from the date they are updated.

 

By using our website, clicking an ‘accept or agree’ box where that option is available or becoming a subscriber to one of our courses, you accept and agree to the terms of this policy and make the following warranties or agreements:

  1. You agree:

 

  • That you use our channels at your own risk and are responsible for evaluating the accuracy, currency, completeness and relevance of any material.
  • We in no way endorse or otherwise support any view, opinion or comment posted by a user or contributor on our channels and provide no warranty (express or implied) about the accuracy, currency or completeness of any material on our channels. Material provided may not be suitable for the area where you live as there are many laws relating to the agricultural industry that change from jurisdiction to jurisdiction (eg declared weeds, farming practices, application of fertilizers or pesticides).
  • You will comply with the terms of use of any platform (such as Facebook) that hosts our channels.
  • You will not post personal information about yourself or others (for example, telephone numbers, email or street addresses).
  • You will treat other people using our channels with respect and courtesy and behave in a civil manner and you will not defame, libel, insult, abuse, harass, stalk, threaten or attack anyone.
  • You will not deliberately disrupt conversations, partake in trolling style behaviour or post material that is off-topic, repetitive or excessively long.
  • You will only use our channels for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of, any other person.
  • You will not transmit any unlawful, discriminatory, defamatory, obscene, offensive or scandalous content or any material that constitutes or encourages conduct that would contravene the law or disrupt the operations of the channels.
  • You will not post any material that is fraudulent, deceptive or misleading and you will not impersonate or falsely represent any other person or organisation.
  • You will not post any material that advertises, offers or promotes anything of a commercial nature.
  • You will not introduce any virus, malicious code or unauthorised cookies or similar technology onto our channels or otherwise damage our channels.
  • You will not market to or collect personal information for marketing purposes from other channel users.
  • You warrant that you have the right to post the material you have posted, the material is not confidential and you have the intellectual property rights in it. You agree you are entirely responsible and liable for any infringement you may make of another person’s intellectual property or other rights when using our channels.
  • It is at our discretion whether we moderate our channels or not.
  • You agree to indemnify us against any claim by a third party arising out of any breach by you of these terms of use.

 

  1. If you breach these terms of use we may, in our sole discretion:

 

  • Remove or refuse to post any material you have submitted (without any obligation to do so);
  • Suspend or permanently block you from using our channels (this includes terminating your access to any closed Facebook group without refund, even if you paid for a course which included the closed Facebook group);
  • Report your conduct to the owner of the relevant platform and/or to any appropriate law enforcement authorities; and/or
  • Take any other action, including legal action, which we consider to be appropriate.

 

  1. We do not accept responsibility for any loss, damage, liability, cost or expense however caused or incurred (including through negligence), which you may directly or indirectly suffer in connection with your use of our channels including use of information posted by us or others.

 

  1. These terms are governed by the laws of New South Wales, Australia.
